Question to article d) Manufacturing experience and Technical Capacity & iii) The Bidder has manufactured goods and commissioned reversible hydro units 200 MW capacity.....
Please remove such a qualification requirements. This requirement should not be part of the tender documentation because it is too detailed. There are not so many PSP in the world with such a range of head and speed. There are only one or two companies in the world who has such a reference for last 10 years. We have our own experienced research center where we can develop any hydraulic design with different parameters and best performances, including required parameters for this tender.

Table 1.1 Material: Steel 20ГСЛ, Steel 35ХМ, Steel 40Х …. Etc.
The material of the steels shall be proposed by the Bidder based on its experience and Worldwide practice. Such a materials are GOST materials and may not be available for foreign Bidders, i.e. giving local Bidders an unfair advantage. Please remove such a requirement and allow to Bidders to propose the materials as per Worldwide standard. The same clarification is relevant to other clauses where materials are indicated.

Question to article 1.1.22 The scope of supply shall include: - Device for measuring water flow rates in the hydro-unit penstock (with 4-20 mA output signal).
Could it be proposed Winter Kennedy measurements of the flow in the spiral case?
Is it possible to provide the penstock drawings for Unit 5? Is this penstock already built? What is material of the penstock? Does the penstock could be drilled?

Question to article 1.5.9 The Supplier shall guarantee safe operation of fasteners in the connections runner....
The coupling elements of the listed connections will be design based on available dynamic loads and will have a safe design. In our point of view, the listed connection will be disassembled by the Customer at planed maintenance works (each 5-8 years).
The requirements 25 years guarantee should be removed because the Bidder will not able to manage the assembly and disassembly works at planned maintenance works.

Question to article 1.6.2 Warranty period for protective coatings that have been fully completed shall be at least 15 years.
15 years warranty is unacceptable.
The warranty time frame should be different for surfaces which are in contact or in non-contact with water and other conditions. The maximum warranty could be 5 years for the surfaces which are not in contact with water, other particular cases should be considered separately. Please allow the Bidder to propose its own specification for the protective coatings

Dear Bidder!
Question to article 1.12.1.4 The full cycle of model tests, including model acceptance tests with the final report on their results, shall be completed within 6 (six) months after the effective date of the Contract.
The time frame 6 months is not acceptable. From our experience, the time frame of the model test for such a project will take 11-12 months minimum. Could you please change the specification as per above value.

As per standard industrial practice, the Bidder shall not confirm efficiency for single points. The more realistic Weight Average Efficiency (WAE) shall be confirmed by bidders. The table with operation points and its weight factors shall be provided by the Customer. Please consider WAE for efficiency guarantee

Question to article 2.2.3.5.4 For the pump-turbine, wicket gate bushings made of СП-ПФ material shall be provided, to operate without lubrication.
Is it possible to offer the oil as per European standard? Our company is usually using the oil from European market. We have a doubts that we may find a TП-30 oil on European market.
The same clarification for the bearings for motor-generator

Is it allowed to propose the Motor-Generator with design from self-extinguishing materials? If yes, then the fire-fighting system is unnecessary. Please confirm that the fire-fighting system should not be designed/delivered in case generator will be made from self-extinguishing materials.

The final completion date of the Supervision of installation and commissioning shall not be a liability of the Bidders, because the erection works will be done by the Purchaser and are beyond the control and responsibility of the Bidder. The Bidder is legally not allowed to issue instructions to the Purchaser’s erection company, and does neither know nor is responsible for the performance of the Purchaser’s erection company. For the same reason, these milestones should not be relevant for LDs for delay . As per our understanding, this contract is focusing on the equipment delivery only. Therefore, LDs for delay should be applied for equipment delivery only, which is under control of the Bidder. Please remove this requirement.

No credit will be given to deliveries before the earliest date, and Bids offering delivery after the final date shall be treated as nonresponsive

Question to article 8. Rules of Acceptance and Supervision. 8.2.2 The equipment shall be considered commissioned if during the commissioning (not included in the scope of the Contract) the requirements of the acceptance test program are fully met and all mechanisms of the hydraulic unit have been operating without fail for 72 hours in total in all design modes (turbine, pump, SCt, SCp), as evidenced by the Operational Acceptance Certificate drawn up by the acceptance committee. The warranty period for the pump-turbine starts from that day.
Due to the unknown performance of the Purchaser’s erection company, the start of the warranty period is beyond the control of the Bidder. The final completion date of the Supervision of installation and commissioning shall not be a liability of the Bidders, because the erection works will be done by the Purchaser and are beyond the control and responsibility of the Bidder. The Bidder is legally not allowed to issue instructions to the Purchaser’s erection company, and does neither know nor is responsible for the performance of the Purchaser’s erection company. For the same reason, these milestones should not be relevant for LDs for delay . As per our understanding, this contract is focusing on the equipment delivery only. Question to SCC / GCC 28.3 Warranty 36 months from date of hydro-unit No. 5 commissioning (pump-turbine and motor-generator) or 60 months from the date of shipment to the final destination (the project Site), “Directorate for Construction of Dniester PSP” Branch, of the last equipment assembly, whichever occurs earlier.
We ask to add the following sentence to this paragraph:
The Warranty shall in any case expire latest 61 months after the Supplier has notified the Purchaser about the readiness of shipment of the Goods.

Question to GCC 35.3 Termination for Convenience (a) The Purchaser, by notice sent to the Supplier, may terminate the Contract, in whole or in part, at any time for its convenience. The notice of termination shall specify that termination is for the Purchaser’s convenience, the extent to which performance of the Supplier under the Contract is terminated, and the date upon which such termination becomes effective.
(b) The Goods that are complete and ready for shipment within twenty-eight (28) days after the Supplier’s receipt of notice of termination shall be accepted by the Purchaser at the Contract terms and prices. For the remaining Goods, the Purchaser may elect:
(i) to have any portion completed and delivered at the Contract terms and prices; and/or
(ii) to cancel the remainder and pay to the Supplier an agreed amount for partially completed Goods and Related Services and for materials and parts previously procured by the Supplier
We ask to amend clause (b) as follows:
(b) The Goods that are complete and ready for shipment within twenty-eight (28) days after the Supplier’s receipt of notice of termination shall be accepted by the Purchaser at the Contract terms and prices. For the remaining Goods, the Purchaser may elect:
(i) to have any portion completed and delivered at the Contract terms and prices; and/or

Question to SCC / GCC 13.1 Delivery and Documents. For Goods delivered from abroad. Warehouse Placement Acceptance Certificate.
The submission of the underlying documents (“originals of the Supplier’s Customs Cargo Declaration”) can significantly be influenced and heavily delayed by other Parties (such as the Purchaser or customs departments and others). Therefore, the Warehouse Placement Acceptance Certificate should not be relevant for transfer of ownership and risk, any payments, or milestones or the evaluation of timely delivery in general.
We kindly ask you to delete the Warehouse Placement Acceptance Certificate from the Contract or at least to reduce its relevance

Question to SCC / GCC 13.1 Delivery and Documents. For Goods delivered from abroad. The ownership and risks for the Goods shall be transferred from the Supplier to the Purchaser upon the Goods delivery and signing of the Warehouse Placement Acceptance Certificate by the Parties in accordance with the terms hereof.
This clause is contradicting the Incoterms condition of CIP Project Site. Please adjust the text according to CIP requirements

Question to SCC / GCC 25.1 Transportation and Incidental Services. Responsibility for transportation of the Goods shall be as specified in the Incoterms.
If not in accordance with Incoterms, responsibility for transportation shall be as follows:
The Supplier shall transport the Goods to the place(s) of final destination specified in SCC 1.1(о) (the Project Site) within the Purchaser’s Country, including insurance and custody of the Goods during the period from the
date of customs clearance by the Purchaser (for Goods supplied from abroad) or from the date of delivery (for Goods supplied within the Purchaser’s country) to the date of Goods delivery to the final destinations,
loading and handling (except for unloading at the final destinations (the Project Sites)), and all related costs shall be included in the Contract Price.
This is contrary to GCC13.1 which states transportation is Bidder risk. We kindly ask you to follow CIP definitions.

Dear Bidder!
Question to SCC / GCC 27.1 Liquidated Damages. The liquidated damage shall be: 0.5 % per week.
The liquidated damage for the delayed delivery will be calculated and applied to the Supplier after the delivery date proposed by the Supplier in the Bid, after the Contract signing (weeks).
We kindly ask to amend this clause as follows: The liquidated damage shall be: 0.5 % of the respective delayed Good’s Price per week.
We ask to add the following sentence to this paragraph:
For the purpose of calculating liquidated damages, the applicable date shall be the arrival date of the Goods at the Project Site. The date of signing the Warehouse Placement Acceptance Certificate by the Parties shall not be considered in this respect.

In accordance with ITB 33.1, 33.2, 33.4 “10 calendar days after announcement of the outcome of technical evaluation of the bid in the “Prozorro”, public opening through “Prozorro” will automatically happen of documents constituting FINANCIAL PART …The exact date and time of financial opening will be indicated at the electronic marketplaces”.
At the website of electronic procurement system “Prozorro” for this bidding process (identification number UA-2025-02-27-013548-a ) there is a comment “The auction will be scheduled after 16th of May, 2025”.
Please clarify whether auction will apply to this bidding process or not.
